Renewal of Trademarks

Steps to follow while applying for trademark renewal A trademark acts as a differentiator between goods or services that are offered from other similar goods or services of a different company. A registered trademark cannot be registered if it is found to be offensive, lack distinctive and contain government logos. However, it is necessary to renew the trademark registration as its validity is up to 10 years. The owner of a registered mark may, during the last year of protection (the tenth year), submit a request to renew the period of protection for the registered mark. The owner is granted a certificate to renew the protection period for another ten years, calculated from the date of expiry of the previous protection period. If the tenth year ends without submitting an application for renewal, it may be submitted within three years and six months following the expiry of the trademark, with additional fees.
